Abstract
Si ricostruisce il percorso argomentativo della Consulta (sentenza n. 156/2025), se ne mettono in luce i principali snodi problematici e se ne valutano le ricadute applicative. Ci si sofferma, in particolare, sulla torsione rispetto alla logica post-referendaria dell’art. 19 St. lav. (con riespansione, di fatto, di una rappresentatività presunta); sull’ambigua portata della nozione di “maggiore rappresentatività comparata”; sul rischio di incremento del contenzioso per la difficoltà di individuare i confini di tale nozione; sulla possibile apertura di spazi di agibilità per i sindacati “nazionali” non accreditati in azienda, cui si accompagna una persistente debole tutela dei sindacati di base radicati nel luogo di lavoro. Si ritiene restino aperti i nodi del rapporto tra effettiva rappresentatività aziendale, accesso alla zona promozionale dello statuto e controllo delle “porte” del sistema.
The note reconstructs the Constitutional Court’s reasoning (Judgment No. 156/2025), identifies its main points of difficulty, and considers the ruling’s practical consequences. It focuses, in particular, on the move away from the post-referendum logic of Article 19 of the Workers’ Statute—entailing, in effect, a renewed reliance on presumed representativeness; on the uncertain reach of the notion of “comparatively greater representativeness”; on the prospect of increased litigation given the difficulty of delineating that notion’s boundaries; and on the potential widening of the space for trade-union action for “national” unions lacking company-level accreditation, coupled with the continuing weak protection afforded to workplace-rooted grassroots unions. The note suggests that key issues remain outstanding as regards the relationship between effective workplace representativeness, access to the Statute’s promotional regime, and the ‘gatekeeping’ of the system.
