Diritto al lavoro e Reddito di cittadinanza

Abstract
Premessa una breve panoramica sulla nozione e tutela dei diritti fondamentali negli Stati democratici, l’Autore si sofferma sul diritto al lavoro e all’occupazione come il primo e più importante di tali diritti. Tuttavia, prosegue l’Autore, tale diritto non è pienamente garantito dallo Stato Italiano, ripercuotendosi così, negativamente, sulla percezione dell’allora c.d. “Reddito di Cittadinanza”, così come dell’attuale “Assegno di Inclusione”, introdotto con il recente Decreto Lavoro in sostituzione del precedente istituto, essendo entrambe le misure condizionate alla fattiva ricerca di altra occupazione. Per l’Autore, solo l’adozione di concrete ed efficaci politiche attive del lavoro potranno rendere equa una siffatta condizione.
Given a brief overview about the notion and the tutelage of the fundamental rights in democratic States, the Author focuses his attention on the right to work and to be employed as the first and most important amongst those rights. However, the Author continues, this right is not fully guaranteed by the Italian Government, thus negatively affecting the receipt of the then so-called “Reddito di Cittadinanza” (Citizenship Income), as well as of the current ‘Assegno di Inclusione’ (Inclusion Allowance), introduced by the recent Work Decree in substitution of the former, being both the allowances conditioned to the effective search for other employment. According to the Author, only the adoption of concrete and effective active labour policies can make such a condition fair.
