Il whistleblowing nella più recente legislazione

Abstract
Il saggio propone una breve riflessione su un aspetto che rappresenta il fulcro dell’intera normativa in materia di whistleblowing, il potenziamento della tutela del whistleblower da possibili misure ritorsive, sia attraverso le nuove disposizioni del Decreto Legislativo n. 24 del 10 marzo 2023, sia attraverso le recenti pronunce giurisprudenziali che hanno offerto una prospettiva concreta ed effettiva al whistleblower nei luoghi di lavoro. Restano, tuttavia, alcune criticità e nodi interpretativi interni alla disciplina e che, solo con il contributo e l’impegno di tutti i soggetti che operano nel sistema, potranno essere affrontati.
The essay offers a brief reflection on an aspect that represents the fulcrum of the entire legislation on whistleblowing, the strengthening of whistleblower protection from possible retaliatory measures, both through the new provisions of Legislative Decree no. 24 of 10 March 2023, and through the recent jurisprudential rulings which certainly represented an important step towards concrete and effective protection of the whistleblower in the workplace, without neglecting, however, to also look at the critical issues and interpretative tangles that the discipline of this particular describes and which, only with the contribution and commitment of all the subjects operating in the system, can be solved.
